Payment & cancellation
Payment
A non refundable booking fee of 20% of the agreed shoot amount will be necessary in order to reserve a time and date for a photoshoot.
Payment must then be made in full within 7 days of receipt of gallery for the photos to be used by client.
Cancellation
For shoots longer than 2 hours, any cancellation made more than 7 days prior to the scheduled shoot time may be rescheduled at no additional cost within 1 month of the original booking date, or at Sophie Tyler’s next reasonable availability.
If a confirmed shoot is cancelled within 7 days of the scheduled shoot time, the booking deposit will be forfeited. Where no booking deposit has been charged, a cancellation fee equal to 20% of the total shoot cost will apply.
For cancellations made within 48 hours of the scheduled shoot time, a cancellation fee equal to 50% of the total shoot cost will apply.
Projects may only be rescheduled once.
For shoots of 2 hours or less (this includes travel time), a minimum of 4 days’ notice is required for cancellations or rescheduling.
Sophie Tyler reserves the right to waive cancellation fees in certain extenuating circumstances.
Should Sophie Tyler become unavailable for any reason, the client will be notified as soon as possible and every effort will be made to reschedule the session. If rescheduling is not possible, Sophie Tyler’s responsibility and liability will be limited to the return of all payments received.
Wet Weather
For shoots that are intended to be outside, and cannot be relocated to a different location, no fee is charged to postpone the shoot to a new date.
Travel
If more than 30 mins travel from Newcastle CBD is required, a travel fee may be added. This will be agreed before the shoot.
License & copyright
License/Copyright
Resale of images is not permitted. License is granted contingent on payment in full. The photographs produced by Sophie Tyler are protected by Australian Copyright Law. The client acknowledges and agrees that copyright remains exclusive property of Sophie Tyler Photography unless agreed in writing prior to the photoshoot. Permission is granted by the client for Sophie Tyler to use the images as we see fit for all media, marketing and promotion including but not limited to online and print.
The client must not alter any print, file or image by any means including cropping, "photoshopping", "filters", altering colours, contrast or exposure in any way.
Single non-exclusive license
Images can only be used for hiring clients only website, brochures and social media only. All photoshoots have a single non-exclusive license unless agreed upon by Sophie Tyler prior.
Third-party license is not given. It is a breach of copyright to give any and all images to others without consent by Sophie Tyler. We ask that you refer everyone to Sophie Tyler for express permission to use images. If a third party (ie supplier or agent) would like to use an image, they can purchase directly from Sophie Tyler.
Multi non-exclusive license
If a multi non-exclusive license is purchased, the client can pass on images to third party including builders, designers, trades and suppliers etc. A Multi non-exclusive license is not in effect without prior agreement.
Delivery Timeframe
Delivery timeframe
Photos will be delivered within 21 days. If images are required earlier, this can be negotiated and accommodated if it is agreed and feasible before the shoot.
Images will be delivered as high resolution JPG files via a private online link. These files will be accessible for 90 days during which time it is the responsibility of the client to make sure they have downloaded and saved a copy to their own computer or harddrive. Sophie Tyler does not permanently archive files and is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read files provided.
